1. Service Description

Testament Health provides workplace drug and alcohol testing services, including point-of-care (POC) screening using approved methods. Services include pre-employment testing, random workplace testing, on-site testing attendance, and digital certificate issuance. Testing is conducted in compliance with relevant UK health and safety legislation.

2. Test Procedures and Methods

Testament Health uses approved testing methods including urine, saliva, and breath alcohol analysis. Test procedures follow industry standards and best practice protocols. Indicative detection windows and testing accuracy are provided upon request. Non-negative results may require laboratory confirmation testing.

3. Confidentiality and Data Protection

All test results are treated as confidential and handled in accordance with UK Data Protection legislation and our Privacy Policy. Results are disclosed only to authorised personnel as specified by the client organisation. Individual test records are maintained securely and retained according to legal requirements.

4. Result Handling and Communication

Negative test results are issued promptly. Non-negative results are communicated confidentially to the authorised client contact. Digital certificates are issued and made available for download with unique identification codes. Clients are responsible for interpreting results and taking appropriate actions in accordance with their employment policies.

5. Client Responsibilities

Clients are responsible for obtaining informed consent from individuals undergoing testing. Clients must ensure that testing is conducted in accordance with their organisational policies and applicable employment law. Clients remain liable for their own compliance with regulatory requirements, including health and safety obligations.

6. Testing Requirements and Access

Individuals presenting for testing must produce a valid form of recognised photo identification before a sample can be collected. Accepted identification includes a current driving licence, valid passport, or CSCS card. Testing cannot proceed if satisfactory identification is not provided. Testament Health may also require individuals to demonstrate fitness for testing. Testing cannot proceed if an individual is unable to provide a valid sample or refuses to participate. Test results may impact site access or employment status as determined by the client organisation.

7. Compliance and Regulatory Alignment

All services are designed to support client compliance with health and safety regulations, site access policies, insurance requirements, and industry best practices. Clients are solely responsible for ensuring that their testing programme aligns with applicable employment law and regulatory obligations.

8. Limitation of Liability

Testament Health provides testing services on an as-provided basis. We make no guarantee that test results are error-free, although we maintain rigorous quality standards. Testament Health is not responsible for consequences arising from client decisions or actions taken based on test results. Clients shall indemnify Testament Health against any claims arising from their use of testing services.

9. Service Fees and Payment

Fees for testing services are as agreed in writing prior to service delivery. An invoice will be issued on or promptly after the testing day. Payment is due within 30 days of the testing date stated on the invoice. Where payment is not received by the due date, Testament Health reserves the right to charge interest on the outstanding amount at 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Payment is accepted by bank transfer (BACS). New clients or engagements involving high headcount or multi-day bookings may be required to pay a deposit in advance of testing; any such requirement will be stated in the written agreement or quote confirmation. Cancellations or rescheduling requests received within 48 hours of the scheduled testing date will be subject to a cancellation charge of 50% of the agreed service fee. Testament Health reserves the right to suspend services or withhold certificates if payment is not received as agreed.

10. Modification and Termination

Testament Health may modify these terms with reasonable notice. Clients may terminate their engagement in accordance with the terms of any service agreement. Outstanding fees remain due upon termination.

11. Governing Law

These terms are governed by English law and the exclusive jurisdiction of the English courts.
